1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is open to all residents of Australia aged 18 years or over who, during the Promotional Period, subscribe or renew their subscription for a minimum of twelve (12) Months to one or more of the following publications: Gourmet Traveller WINE, Gourmet Traveller, Wheels, Motor, Unique Cars, Street Machine. Motorcycle Trader, ADB, 4X4 Australia, Caravan World, Campertrailer Australia, Trade-a-Boat, Top Gear, Money, Empire, Rolling Stone, Rugby League Week, Men’s Style, APC, Techlife, World of Knowledge and Australian Geographic. Entry is subject to verification of the credit card or, if payment is made by cheque, the cheque must be cleared for payment by the close date of the promotion (promotional period). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

  3. The promotion commences 21 July 2014 at 00:01am (AEST) and closes 11:59pm (AEST) on 28 September 2014 (“Promotional Period”). The draw will take place at the Bauer Media, Level 23, Civic Tower, 66 – 68 Goulbourn Street, Sydney NSW 2000 at 11:00am AEDST on 8 October 2014. The Winner will be notified in writing within seven (7) business days of the draw and the winner’s name will be published on www.magshop.com.au for 28 days from the publishing date and in the public notices section of The Australian on 15 October 2014.

  4. The Promoter’s decision in relation to all components of the promotion is final and binding on all who enter and no correspondence will be entered into.

  5. To enter, eligible individuals must, during the Promotional Period, either:

    • Visit www.magshop.com.au/fathersday or www.magshop.com.au and subscribe for a minimum of 12 months online (clearly specifying the name of the magazine they wish to subscribe to or renew their subscription to); OR

    • Obtain a subscription for a minimum of [12 months via telephone by calling 136 116 (Mon – Fri 8am AEST/AEDST – 8pm AEST/AEDST, whichever is applicable in NSW). Entrants must quote the promotional code relating to the magazine they wish to subscribe to (or renew their subscription to) which can be found online at www.magshop.com.au. Maximum cost of call is 55c. Calls from mobile and pay phones may attract a higher rate.

    Payment for the subscription can be made via credit card or a cheque for the relevant amount can be sent to Reply Paid 4967, Sydney, NSW 2001, with the entrant‘s name and all other required details as per the instructions provided at the time of subscription application. Entry is subject to verification of the credit card used for payment of the subscription or, if payment is made by cheque, the cheque must be cleared for payment before the close date of the promotion.

  6. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per eligible subscription, (b) an exception of subscriptions purchased on behalf of a friend where two (2) entries will be awarded in respect of a single subscription (one (1) entry to the purchaser and one (1) entry to the friend); and (c) each entry must be submitted separately and in accordance with entry requirements.

  7. The first four (4) valid entries drawn from all valid entries received in the draw will each win: One (1) X Samsung 65” Series 8 “Curved” LED 3D Smart TV model no:UA65H8000AW valued at up to $5,999. The total prize pool for the entire promotion is valued at $23,996 (including GST). The prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

  8. A Standard Samsung 12 month warranty applies on the Samsung 65” Series 8 “Curved” LED 3D Smart TV model no:UA65H8000AW.

  9. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

  10. The prize does not include any installation or set-up of any of the products.

  11. Products included in prize package (including but not limited to titles, colour, design, sizing, model, finish, style etc) will be determined by the promoter in its complete discretion. All prizes must be taken as offered.

  12. The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.

  13. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.

  14. Prize is subject to the standard terms and conditions of individual prize and service providers.

  15. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

  16. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

  17. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

  18. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.

  19. If necessary, an unclaimed prize draw will be held on 8 January 2015 at the same time and place as the original draws in order to distribute any unclaimed. Any winner from this draw will be notified by email and their name will be published in the public notices section of the Australian 12 January 2015.

  20. By entering the promotion via SMS an entrant consents to the Promoter using the their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of your entry in the promotion.

  21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

  22. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

  23. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

  24. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

  25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

  27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  28. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

Privacy: The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
